The story, neutrally told

Mixed · 2California sued the Trump administration for the 100th time on Thursday 15 October 2026, challenging ICE agents' arrests of people for alleged civil immigration violations at or near state courthouses. Mixed · 2Attorney General Rob Bonta argues the practice undermines state sovereignty under the Tenth Amendment, breaches a common-law bar on enforcement against people attending court, and violates the Administrative Procedures Act and the Immigration and Nationality Act. Left · 1Bonta said fear of arrest has led to serious criminal charges being dropped and cases jeopardised because victims and witnesses are afraid to testify; defence attorney Alejandro Barraza described clients arrested after hearings and one who pleaded guilty to avoid a jury trial for fear of ICE.

Left · 1The Los Angeles Times reported that an ICE memo in May 2025 allowed civil enforcement actions in or near courthouses when agents have credible information a target will be present, and that ICE has defended the arrests as a "common sense" approach; ICE and the White House did not immediately respond to the paper's requests for comment. Left · 1In June, U.S. District Judge P. Casey Pitts struck down ICE's expanded courthouse arrest policies nationwide, a ruling the administration is appealing; California courts have since logged 30 arrests in June, 29 in July, 19 in August and 14 in September, and Gov. Gavin Newsom last month signed a law extending protections to within 1,000 feet of courthouses. Mixed · 2Bonta called the milestone "sobering" and "somber", saying it reflects Trump's lawlessness rather than political interference; on MS NOW he said the president had violated the law 100 times in 90 weeks, citing the military on the streets, tariffs and withheld funds he put at $200 billion.

Left · 1The White House has consistently called Bonta's litigation baseless and misguided; in August spokesperson Abigail Jackson told him to stop "filing frivolous lawsuits" and focus on problems in his own state. Left · 1Legal experts cited by the Times said lawsuit volume reflects both rising use of executive power and state responses, with California having sued over 120 times in Trump's first term; Stanford's Michael McConnell called many suits "legally meritorious" but objected to taxpayer money funding "ideological lawsuits". Left · 1Bonta said the suit is needed despite the new state law because the administration thinks "no state law applies to them", noting the 9th Circuit this week blocked a California law requiring federal immigration agents to display identification.
