Defence says FBI delayed court appearance of DC pipe bomb suspect to extract confession

Lawyers for Brian Cole Jr., accused of planting pipe bombs outside the Democratic and Republican national committee offices before the Jan. 6, 2021 Capitol attack, filed a motion on Tuesday asking a federal judge to throw out his statements to the FBI. They say agents kept him from a judge "sitting minutes away" so they could keep questioning him. According to the filing, agents arrested Cole shortly before 7 a.m., told him he would likely see a judge that afternoon, and instead had him sign a form waiving the right to appear that day; he saw a judge the next day.

The defence argues Cole's autism left him unable to withstand coercive tactics, and that he agreed the person in surveillance video was him about three hours into questioning. Federal rules require prompt presentment before a judge, and the defence says a confession given more than six hours after arrest can be excluded if the delay was unreasonable. A defence-hired expert, Richard Leo of the University of San Francisco, concluded the interrogation was psychologically coercive.

Rep. Thomas Massie (R-KY) called for FBI Director Kash Patel to resign once the matter is resolved, and said Cole should be released on an ankle bracelet until trial. Cole has pleaded not guilty; his trial is set for Feb. 16, 2027, and the judge must decide whether to hold an evidentiary hearing on the motion.
