The aide said the issue is whether the administration could act to stop a project after a court has rejected that action, and that the change could also affect oil and gas projects. A senior Republican aide disputed that the text was changed discreetly, saying it had been unchanged since the previous Wednesday and that Democrats raised the issue only around 9 p.m. Tuesday.

The Republican aide added that Senate Republicans had decided against reopening language changes "at this late hour". On Wednesday, Republicans and Democrats announced a deal, the Bipartisan American Affordability and Jobs Act, after months of negotiations on speeding federal approvals for energy and infrastructure projects, according to the Washington Examiner. Sen. Shelley Moore Capito (R-WV) called it a major step toward faster, easier infrastructure building and said it would not give up environmental protections.

Sen. Sheldon Whitehouse (D-RI) said provisions barring the executive branch from blocking energy permits were still "unresolved" and awaited more clarity on a Trump administration proposal. The deal reportedly sets a 150-day deadline for legal challenges to environmental reviews, and the text had not yet been released. Talks began after the Trump administration halted construction of five offshore wind farms last December; courts overturned all five stop-work orders, but Raw Story says the projects were again put on hold Wednesday.

A vote is not expected until after the midterm elections, and the Examiner says passage remains an uphill battle.
