Federal appeals court halts Christa Pike's Tennessee execution an hour before it was due

The story, neutrally told

A federal appeals court halted the execution of Christa Pike in Tennessee about an hour before it was due to begin on Wednesday 30 September. The 6th Circuit ordered a "short stay of execution" to weigh Pike's claim that her allegations of childhood sexual abuse were not adequately considered at sentencing, without giving a timeframe. According to ABC News and Fox News, the order was 2-1. Judge Jane Branstetter Stranch wrote for the majority, and Judge Richard Allen Griffin dissented, calling it "another last-ditch meritless effort to delay a lawful execution."

Tennessee's attorney general's office immediately asked the U.S. Supreme Court to vacate the stay, arguing Pike's claim was already unsuccessfully presented and that the victim's family deserves closure. Pike, 50, was 18 in 1995 when she and her boyfriend Tadaryl Shipp killed 19-year-old classmate Colleen Slemmer in Knoxville; Shipp, 17 at the time, received life with the possibility of parole. She would have been the first woman Tennessee executed in at least 200 years, after Governor Bill Lee denied clemency on Monday and the Supreme Court refused a stay on Tuesday.

Her lawyers cite severe abuse including rapes at 11 and 17, bipolar disorder and PTSD; Slemmer's mother, May Martinez, wants the execution carried out. The stay is temporary, and it is unclear how long the delay will last.
